These terms govern your use of ServiceStake (servicestake.com), which is owned and operated by Inferno Marketing (78212 Newfoundland and Labrador Limited) ("ServiceStake," "we," "us" or "our"). By using the site, you agree to these terms. If you do not agree, please do not use the site.
What ServiceStake is
ServiceStake is a free directory of home services franchises and dealer programs. It helps people compare ownership opportunities and contact the programs they are interested in.
ServiceStake is an information service. It is not an offer to sell, or a solicitation of an offer to buy, any franchise or business opportunity. Franchise offerings are made only by the franchisor, through its Franchise Disclosure Document, in the states where that is required.
The information on listings
- Sources. Listing information comes from public sources: each brand's own website, its franchisor's website, or its franchise disclosure document filed with a state regulator. Each figure on the site shows its source and the date we checked it.
- Accuracy. Programs change their terms, costs and availability. We work to keep listings accurate, but we do not guarantee that any information is complete, current or error-free. Always confirm details directly with the program and review its Franchise Disclosure Document before making any decision.
- No earnings claims. ServiceStake does not publish earnings, revenue or profit figures for any program.
- Not advice. Nothing on ServiceStake is financial, legal, tax or investment advice. Buying a franchise or joining a dealer program involves real financial risk. Speak with qualified advisors, including a franchise attorney and an accountant, before you invest.
- Not an endorsement. A listing on ServiceStake is not a partnership with, or an endorsement of, that brand. Brands are listed from public sources, and unclaimed listings have not been reviewed by the brand. Appearing in the SBA Franchise Directory means a brand is eligible for SBA financing review; it does not mean the SBA has approved or endorsed it.
How ServiceStake makes money
ServiceStake is free for candidates and brands. Inferno Marketing earns revenue when a franchise or dealer program hires it to find and screen owner candidates, paid per qualified call. Listings are never sold, paying clients get no better placement, and brands that are Inferno clients are marked "Inferno client" on their listing.
Inquiries
When you submit an inquiry, you authorize us to share the details you provide with the program you selected so it can contact you. We pass your inquiry along, but we do not control whether, when or how a program responds, and we are not a party to any agreement between you and a program. Any decision to buy a franchise or join a program is yours alone, made directly with that program.
Claiming a listing
Only an authorized representative of a brand may claim its listing. A claim from an email address on the brand's own website domain is verified automatically. A claim from any other work email address is verified by us before the listing is activated. Claims from free email services, such as Gmail or Yahoo, are not accepted. By claiming a listing, you confirm you are authorized to act for the brand and that the information you provide is accurate and not misleading. Brands are responsible for the content they add, including logos, photos and descriptions, and confirm they have the right to use it. We may edit or remove listing content that is inaccurate, misleading or in breach of these terms.
Acceptable use
You agree not to:
- submit false information, or inquire or claim a listing on someone else's behalf without permission;
- copy, scrape or harvest the directory or its data by automated means;
- interfere with the site's operation or security;
- use the site for any unlawful purpose.
Intellectual property
Brand names, logos and trademarks belong to their owners and appear on ServiceStake only to identify the brands listed. The ServiceStake name, logo, site design and original content belong to us. You may view and share individual pages for personal, non-commercial use.
Disclaimers
ServiceStake is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, ServiceStake, Inferno Marketing and 78212 Newfoundland and Labrador Limited are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of the site, your reliance on listing information, or your dealings with any program. Our total liability for any claim relating to the site will not exceed one hundred US dollars (US$100).
Indemnity
If you are a brand that claims a listing, you agree to indemnify us against claims arising from content you provide or your breach of these terms.
Changes and termination
We may update these terms, and the date at the top will show when they last changed. Continuing to use the site after a change means you accept the updated terms. We may suspend or remove access, listings or content at our discretion.
Governing law
These terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada that apply there, and disputes will be resolved in the courts of that province, unless the law where you live requires otherwise.
